Terms of service

These terms govern every purchase from attaiecigars.com, the online store of Attaie Cigar Company ("Attaie", "we"). By placing an order you accept them.

1. You must be 21 or over

Our cigars are sold only to adults of 21 years of age or over. By placing an order you certify that you are 21 or older, that the name, date of birth and address you have given are your own and true, and that you understand that providing false information, or buying tobacco for a person under 21, is unlawful. We verify your age and identity against public records when the order is placed, may ask for a copy of your government-issued identification where a state requires it or where the records do not match, and require the signature of an adult of 21 or over, with photo identification, when the parcel is delivered. We may cancel any order we cannot verify.

2. Where we sell

We sell to guests in the United States only, and only to the states listed in our Shipping policy. We may decline or cancel an order to an address we cannot lawfully or practically serve, including PO boxes, military and diplomatic addresses, parcel lockers and forwarders. Our cigars are not offered for sale to anyone in a country or state where their sale, advertising or delivery by post is prohibited.

3. Payment

Payment is taken by credit or debit card in the guest's own name; the billing address must be the cardholder's. Your card is authorised when the order is placed and charged when the parcel is dispatched. Prices are in US dollars. Sales tax, and in some states a tobacco tax, is added at checkout. The charge appears on your statement as ATTAIE TOBACCO PRODUCT, the wording California law requires, followed by our telephone number. We do not accept payment through digital wallets, buy-now-pay-later services or cryptocurrency.

4. Allocations and availability

Our cigars are made in small batches and are often between allocations. An allocation request is not an order and takes no payment; we write to you when your cigars are ready and you then place an order in the ordinary way. We may limit the quantity sold to any one guest. An order is accepted only when we dispatch it; until then we may cancel it and release the authorisation on your card, for example if a cigar proves unavailable or a price was shown in error.

5. Delivery and risk

Delivery is by UPS with Adult Signature Required, as described in our Shipping policy, which forms part of these terms. Risk in the goods passes to you when the parcel is signed for.

6. Returns and refunds

Our Return and refund policy, which forms part of these terms, sets out when a refund or replacement is made. Tobacco that has been delivered and signed for is otherwise not returnable.

7. No resale

Our cigars are sold for personal enjoyment. They may not be resold, and may not be supplied to anyone under 21. Venues and retailers who wish to offer Attaie are welcome to write to the guest desk about the Host programme, which has its own agreement and requires the appropriate state tobacco licence.

8. Health

Cigar smoking can cause cancers of the mouth and throat, even if you do not inhale. Cigars are not a safe alternative to cigarettes. Tobacco smoke contains chemicals known to the State of California to cause cancer and birth defects or other reproductive harm; our product pages and parcels to California carry the Proposition 65 warning. We make no claim that our cigars are natural, additive-free, or less harmful than any other tobacco product.

9. The website

The site and its contents are ours or our licensors'. You may browse and share links; you may not copy our photography, models or text for commercial use. The age gate on the site is a courtesy and does not replace the verification described in section 1. Our Privacy policy explains what we do with your information, including the fact that we share your name, address and date of birth with our age-verification provider for the purpose of verification and keep the result for the period the law requires.

10. Liability

Nothing in these terms limits liability that cannot be limited by law. Otherwise our liability for any order is limited to the price paid for it. We are not liable for delays or failures caused by the carrier, by weather, or by events outside our control.

11. Law

These terms are governed by the laws of the State of California and the United States, and any dispute will be heard in the state or federal courts for Alameda County, California. If any part of these terms is found invalid, the rest remains in force. We may update these terms; the version in force when you order applies to that order.
